Duty of Candour Report 2023 - 2024

A culture of being open and honest is fundamental to Seafield Health Solutions relationship with (and between) clients, the public, staff and other organisations.

Introduced under the provisions of the Health (Tobacco, Nicotine etc. and Care) (Scotland) Act 2016, the organisational duty of candour procedure is a legal duty that sets out how organisations should tell those affected that an unintended or unexpected incident appears to have caused harm or death, to apologise and to meaningfully involve them in a review of what happened.

The Duty of Candour Procedure (Scotland) Regulations 2018  set out the procedure that organisations providing health, care and social work services in Scotland are required by law to follow when there has been an unintended or unexpected incident that results in death or harm (or additional treatment is required to prevent injury that would result in death or harm).

Whilst there are already professional duties of candour such as those required by the Nursing and Midwifery Council, the General Medical Council and the General Optical Council, this statutory organisational duty has been developed to be in close alignment with the requirements of these professional duties and designed to be mutually supportive.
